All Terrain Vehicle Resolution

BLUE RIDGE ACRES CIVIC ASSOCIATION, INC.

At the Blue Ridge Acres Civic Association (BRACA) Board meeting held June 15, 2004, the following resolution was adopted by a majority of the Board of Directors present:

BRACA RESOLUTION REGARDING ALL TERRAIN VEHICLES (ATV)

Whereas, the Blue Ridge Acres Civic Association, Inc. (BRACA) is the owner of record of all the roads within the Blue Ridge Acres Subdivision and represents the common good as to the state and usage of said roads within the Blue Ridge Acres Community; And,

Whereas, it is the continuing expectation of the property owners of Blue Ridge Acres as represented by BRACA that the historical right to safe passage over the roads, the right of way, together with the right to tranquil well being and the peaceful enjoyment of property adjacent to the roads be maintained; And,

Whereas, the Community’s tranquility has been compromised by individuals, both from outside the Blue Ridge Acres Community and from within the Community, by reason of their unauthorized recreational use of ATV’s and off-road motorcycles on the roads within the Blue Ridge Acres Community ; And

Whereas, the apparent disregard by the ATV’s operators to the noise and dust produced, jeopardizing the safety of both themselves and others and the complete disregard of private property is in direct conflict with the stated and desired expectations of the property owners and residents of Blue Ridge Acres as represented by BRACA.

Now therefore, the BRACA, having the authority to pass rules and regulations regarding the usage of the roads within Blue Ridge Acres from time to time by virtue of its ownership of the roads and/or the right of way on the roads of Blue Ridge Acres and the expectation of the property owners and residents of Blue Ridge Acres that the peace and quiet of the Community not be compromised by the misuse of the Community’s roads, does hereby direct and authorize the BRACA Board of Directors to act as follows:

1. Authorize an ATV Rules and Regulations Committee (ATVRRC) and appoint a Chairman.
2. Direct the ATVRRC to place in writing Rules and Regulations regarding the use of ATV’s on roads it owns and to make the same available to concerned parties and to post same.
3. Empower the ATVRRC to issue tiered citations, fines and ultimate confiscation of ATV’s pursuant to West Virginia Statute for criminal trespass to violators.
4. Develop operational enforcement procedures, including the appointment of a Chief Enforcement Officer and make appropriate pre-arrangements with law enforcement agencies and a bonded impound service.

Matching Funds Resolution

BLUE RIDGE ACRES CIVIC ASSOCIATION, INC.

At the Blue Ridge Acres Civic Association (BRACA) Board meeting held September 25, 2001, the following resolution was adopted by a majority of the Board of Directors present:

BRACA ROAD MAINTENANCE
MATCHING FUNDS PROGRAM


Based upon the need for making our financial resources go as far as possible and to encourage participation by BRA residents in the maintenance of our roads, BE IT RESOLVED that the Blue Ridge Acres Civic Association Inc. (BRACA) establishes an ongoing policy of matching funds with residents wherein the BRACA will authorize the partial reimbursement of funds expended for road improvement by any resident in good standing. More specifically, the reimbursement is to operate under the following guidelines:
1. A plan or description of the proposed work and/or material together with an estimate as to its cost must be presented to the BRACA Board before work commencement. Written plans and cost will be given precedence over verbally described plans.
2. Only work performed on BRACA owned roads is to be considered for reimbursement. Work performed on private drives, for example, is excluded.
3. Labor performed by the resident proposer is not reimbursable.
4. The Board must approve the work by a vote of record together with a maximum reimbursement amount, nominally half the expected cost, although more or less than half is also possible at the Boards discretion. A written memorandum authorizing the work together with a deadline for its completion is to be sent to the resident proposer.
5. Any work performed by a contractor in executing the project is performed under a contract to the resident proposer and not with the BRACA.
6. Reimbursement to the resident proposer is to occur at the completion of the entire work project, as determined by the Chairman of the Roads Committee, with payment to be made to the resident proposer only after all incurred costs have been paid for by the resident proposer.
7. Work examples include but are not limited to culvert installations to existing driveways, paving, road ditch hydro-seeding etc. Capitol improvement projects will be given precedence over maintenance of existing roadways.
8. Agreement to any proposal is at the discretion of the BRACA and is subject to availability of funds.

Board Guest Policy Resolution

BLUE RIDGE ACRES CIVIC ASSOCIATION, INC.

At the Blue Ridge Acres Civic Association (BRACA) Board meeting held April 17, 2001, the following resolution was adopted by unanimous vote of the Board of Directors present:

OPEN BRACA BOARD MEETINGS POLICY

BE IT RESOLVED that the “closed Board meeting policy” adopted by the BRACA Board on November 15, 1997 is hereby rescinded and henceforth all BRACA Board meetings, regular or special, at which BRACA Business may be conducted are open to any general member (Guests) pursuant to the BRACA bylaws and additionally the following conditions:

1. A Guest may not voice their comment or opinion while the Board is in session unless one or more Board members ask them to do so.
2. At the conclusion of any formal meeting and before adjourning, any guests present are to be solicited by the Board for any comments they may wish to direct to the Board, which comments are on the meeting record.
3. The Board may go into executive session, to the exclusion of some or all Guests present at any time by motion and affirmation by the Board to do so with respect to one or more named specific subjects. The BRACA Board reserves the right, when it is in the best interests of the Community, to keep executive sessions confidential.
4. Any Actions (motions and vote) taken by the Board while in executive session are to become part of the written record within thirty days following or at the next regularly scheduled meeting, which ever occurs first, or they become null and void.
5. The Board and any individual Board member reserves the right to meet with any other Board member(s) in informal session at any time or at any place of their choosing. However, any business conducted at such a meeting does not have the authority of the BRACA until such time as the Board of Directors adopts the same at a regularly scheduled or special meeting at which this resolution applies.
6. The BRACA Board affirms that they are Volunteer Trustees of the Blue Ridge Acres Community’s property and rights-of-way and as such actively encourage the presence and participation of Guests at BRACA Board meetings to the end that all needed business concerning the Community’s roads is conducted in an orderly and efficient manner. The Board encourages the Community to voice their concerns, opinions, information etc. in writing directed to the BRACA Board.

State Take Over Resolution

BLUE RIDGE ACRES CIVIC ASSOCIATION, INC.

At the Blue Ridge Acres Civic Association (BRACA) Board meeting held March ___, 2001, the following resolution was adopted by a majority of the Board of Directors present:

APPLICATION FOR INCLUSION INTO THE WV STATE ROADS SYSTEM

Based upon the merits of the Orphan Road Program (HARP) as it applies to the roads of Blue Ridge Acres, documentation that a majority of property owners wish to have the Community's roads incorporated into the WV State Road System and a resolution adopted at the February 10, 2001 BRACA Annual meeting by a majority of those present, BE IT RESOLVED that the Legal Committee of the Blue Ridge Acres Civic Association Inc. is authorized and directed to:
(1) Write a letter forthwith to the West Virginia Department of Transportation (WV DOT) making application for inclusion of the Community’s roads into the WV State roads system, and asking how the BRACA may facilitate that inclusion process.
(2) Proceed forthwith to comply with any and all requests made by the WV DOT so as to facilitate the transfer of the Community’s roads to the WV DOT in a timely manner.
(3) Be authorized to seek the advice of the BRACA’s attorney as needed in preparing any and all needed documents as the WV DOT may request to effect the transfer, and to pay for such legal services out of road fee monies.

Road Warriors Resolution

BLUE RIDGE ACRES CIVIC ASSOCIATION, INC.

At the Blue Ridge Acres Civic Association (BRACA) Board meeting held March ___, 2001, the following resolution was adopted by a majority of the Board of Directors present:

ESTABLISHMENT OF (VOLUNTEER) ROAD WARRIORS

Based upon the need for inclusion of all volunteers into the maintenance of the Community’s roads, BE IT RESOLVED that the Roads Committee of the Blue Ridge Acres Civic Association Inc. is authorized and directed to organize members of the Blue Ridge Community who wish to participate into an informal group, to be known as the Blue Ridge Acres Road Warriors (Road Warriors), whose organization and purpose is expressed in the following:
1. Volunteer Neighborhood Captains are to be identified in each neighborhood of the Blue Ridge Community who will serve as liaison spokespersons for their respective neighborhoods. Every resident will be in a neighborhood and their Captain is to inform all current residents and new future residents within his neighborhood of his responsibility etc.
2. Neighborhood Captains, together with the Roads (Committee) Chairman, will organize work parties from time to time for the purpose of maintaining their neighborhood roads and communicating road / ditch hygiene, e. g., cleaning of leaves and mud from culverts, and other responsibilities, particularly the road fronting each resident’s home. Required material and work falling outside the capabilities of the neighborhood group, e.g., access to gravel, shale fill, appropriate equipment etc., is to be identified and taken note of by the Neighborhood Captain and communicated to the Roads Chairman. The Roads Chairman will, at his discretion and based upon availability of resources, make arrangement for the requested material.
3. Neighborhood Captains will communicate to the Roads Chairman their respective neighborhood needs and status in BRACA Board or BRACA Road Committee meetings.
4. The BRACA Board, in conjunction with the Roads Committee Chairman, is to identify each section of road in Blue Ridge Acres as being either Primary or Secondary and establish maintenance requirements (road width, overhead tree clearance etc.) for each.
