Minutes of Board of Directors Meeting
August 17, 2004
Board Members Absent: None
Guests Present: James Riner, Art Hanson, Eddie Pauls
Bill Ramsey called the meeting to order at 7:05 PM.
Special Action by BRACCA Board:
Bill Ramsey requested that the BRACCA Board entertain a request by Mr. Riner prior to the normal agenda sequence and this was granted.
At issue is the need to remove a large dead elm tree, install a culvert and reroute the roadside ditch along Country Club Drive below where it intersects Sycamore Road adjacent to Mr. Riner’s residence on Lots 29-32, Section RC-1. After some discussion, it was unanimously approved that the BRACCA is to give a culvert and $50 to Mr. Riner in return for him removing the elm tree, installing the culvert across Sycamore and digging the ditch on down to where a culvert discharges after it crosses Country Club onto Mr. Riner’s property.
Minutes:
(1) Don Orser presented the minutes for the July 20, 2004 BRACA Board meeting. They were approved with the exception that the Treasurer’s Report, due to Elliot’s absence on July 20th was made an interim report and Elliot provided a two month report for the period June 16 through August 17, 2004 on August 17, 2004.
Treasurer’s Report: Elliot Simon.
(2) For the period June 16 through August 17, 2004: The opening balance total of money market and road maintenance was $20,246.05, total deposits were $7548.68, expenditures were $3490.74, for an ending total balance of $24,303.99. The administrative fund ending balance is $3523,24.
(3) As a result of the BRACA’s road fee collection efforts on in arrears accounts, something like $7,000 has been collected.
(4) A letter was written to Susan Presley concerning her bill of approximately $800.
(5) Scott Henry’s address is needed and Orser will obtain it.
(6) Need transfer information on Harmon to Couch transfer. Orser will obtain.
(7) Need transfer information on Marx to new owner. Orser will obtain.
(8) Records will be changed to reflect Garrison to Mark Smith transfer.
(9) Will add Kerry Fries to arrears list to obtain judgement.
(10) Records show Hathaway owes for 2004. This will be taken care of at Hathaway (to Susan Adams) settlement.
(11) Leonard Erickson’s Estate is in arrears. Orser will check as to ownership.
Committee Reports:
Roads Committee: Fred Horning Reported.
(12) The hydraulic pump for the Ford truck dump lift is still not fixed (Shenandoah Sales) and the estimate is now about $1200 to replace the hydraulic pump.
(13) Fred has received several complaints from those owning lots beyond the end of the road regarding the large culvert John Bailey installed across the stream just beyond his house at the north end of Paw Paw Way as it has created a large “hump” in the road. This will be looked into by Fred and Bill.
(14) Earl G. Cogle has contacted us about performing some road work. The BRACA approved a motion to have him do some work under Fred’s supervision.
(15) Bill Ramsey has received a letter from Michelle Willete on Blue Ridge Loop regarding Orser’s ditch maintenance adjacent to her property.
Legal Committee: Bill Ramsey Reported.
(16) Bill reiterated that a number of large bills have been paid up, including a partial payment by Lee Scanlon.
(17) The generic letter addressed to realtors and closing attorneys drafted by Orser telling them of BRACA’s road fee schedule and BRACA contacts was approved.

(18) Bill Ramsey signed a letter Orser had prepared putting in writing Mark Smith’s verbal promise to repair the blacktop adjacent to the two homes Smith is building on Persimmon Pear.

(19) Eddie reported that the BRACA web pages have not been updated for some time. Additionally, the “hot Issues” postings have become a problem due to non-constructive anonymous messages destroying any ones desire to become involved in a constructive manner, and these need to be stopped by requiring that posters give a legitimate ID.
(20) Eddie introduced Art Hanson who will take over from Eddie Pauls as BRACA web master.
(21) Art gave a brief overview of his proposed web page format and how it might be maintained.
(22) It was proposed that those interested in pursuing this in more detail meet at Elliot Simon’s house on Monday, August 23, 2004.
Old Business:
(23) Orser has obtained a copy of WV H. B. 4022, which was enacted by the WV Legislature to allow for the regulation of all terrain vehicles, including regulation of ATV’s by homeowners associations. This latter requires that the County Commission be petitioned by BRACA and Orser has started to draft such a petition.
