Minutes of Board of Directors Meeting
June 15, 2004
Board Members Absent: None
Guests Present: None
Bill Ramsey called the meeting to order at 7:12 PM.
Minutes:
(1) Don Orser presented the minutes for the May 18, 2004 BRACA Board meeting and they were approved.
Treasurer’s Report: Elliot Simon Reported.
(1) For the period May 19 through June 15, 2004, the combined money market and checking account balance as of this date is $20,242.38 reflecting disbursals totaling $2,187.20 and deposits of $2981.67 for a net gain of $1,146.12 for the period. The Administrative Fund is $3574.23, down $351.65 for corporation tax preparation, corporation tax and insurance.
(2) Tom Marchone did the corporate tax return for a fee of $300.
(3) Several letters were received: (1) An anonymous letter indicated someone on Maple Ridge is in the car business. Bill Ramsey will investigate and talk to the person as needed.
(4) Michael Snyder indicated in a letter addressed to the Board the need for culvert work on Red Oak Lane. Bill Ramsey will speak John Bates about what John thinks should be done.
(5) In answer to a question regarding BRACA’s need to pay a “use tax”, Elliot indicated it was to make up the difference between WV sales tax and VA/MD sales tax.
(6) The Perinis situation is still outstanding and Orser will attempt to find original judgements.
Committee Reports:
Roads Committee: Fred Horning Reported.
(7) The hydraulic pump for the Ford truck dump lift will cost about $1000 to replace and labor will be something like $500.
(8) Ron Linton has asked for and arrangements were made for Ron Linton to obtain gravel from the pile adjacent to the equipment barn to put on BRACA roads, particularly on the corner in front of his house as well as in potholes on Dey etc.
(9) The need to line up someone to take Walter Lipka’s place in removing snow was discussed.
(10) The damage to the blacktop adjacent to Mark Smith’s building projects was discussed and Orser was asked to write a letter to Smith placing in writing verbal Smith’s agreement to repair the blacktop when he paved the driveways to the completed houses this fall.
Legal Committee: Bill Ramsey reported.
(11) Bill had been contacted regarding the Robert Merrill foreclosure and an agreement worked out whereby most of what was owed the BRACA for arrears road fees was paid.
(12) Peter Pentoney has filed writ of executions on six of BRACA’s road fee judgements enabling the Jefferson County Sheriff’s Office is to seize personal property with the intent of auctioning it off for the purpose of paying BRACA’s judgements.
Architectural Review Committee: Don Orser Reported
(13) Scott Henry has purchased the Perkinson property, Lots 50, 51, 55, 56, 61, Section C and an irregular 0.164 acre slice near the entrance. It does not appear that a driveway can be opened to the entrance due to a narrow strip of land adjacent to the entrance over which no right-of-way exists. Orser provided a plat of the situation and the situation was discussed.

(17) After some discussion, the BRACA Board unanimously passed the following resolution:
BRACA RESOLUTION REGARDING ALL TERRAIN VEHICLES (ATV)
Whereas, the Blue Ridge Acres Civic Association, Inc. (BRACA) is the owner of record of all the roads within the Blue Ridge Acres Subdivision and represents the common good as to the state and usage of said roads within the Blue Ridge Acres Community; And,
Whereas, it is the continuing expectation of the property owners of Blue Ridge Acres as represented by BRACA that the historical right to safe passage over the roads, the right of way, together with the right to tranquil well being and the peaceful enjoyment of property adjacent to the roads be maintained; And,
Whereas, the Community’s tranquility has been compromised by individuals, both from outside the Blue Ridge Acres Community and from within the Community, by reason of their unauthorized recreational use of ATV’s and off-road motorcycles on the roads within the Blue Ridge Acres Community; And
Whereas, the apparent disregard by the ATV’s operators to the noise and dust produced, jeopardizing the safety of both themselves and others and the complete disregard of private property is in direct conflict with the stated and desired expectations of the property owners and residents of Blue Ridge Acres as represented by BRACA.
Now therefore, the BRACA, having the authority to pass rules and regulations regarding the usage of the roads within Blue Ridge Acres from time to time by virtue of its ownership of the roads and/or the right of way on the roads of Blue Ridge Acres and the expectation of the property owners and residents of Blue Ridge Acres that the peace and quiet of the Community not be compromised by the misuse of the Community’s roads, does hereby direct and authorize the BRACA Board of Directors to act as follows:
1. Authorize an ATV Rules and Regulations Committee (ATVRRC) and appoint a Chairman.
2. Direct the ATVRRC to place in writing Rules and Regulations regarding the use of ATV’s on roads it owns and to make the same available to concerned parties and to post same.
3. Empower the ATVRRC to issue tiered citations, fines and ultimate confiscation of ATV’s pursuant to West Virginia Statute for criminal trespass to violators.
4. Develop operational enforcement procedures, including the appointment of a Chief Enforcement Officer and make appropriate pre-arrangements with law enforcement agencies and a bonded impound service.
So enter it into the records of the Blue Ridge Acres Civic Association this 15 day of June 2004.
