Minutes of Board of Directors Meeting
March 16, 2004
Board Members Absent: Fred Horning
Guests Present: Sue & Eddie Pauls, Bryan & Terry Lock, Charles & Ann Mountz, Chip Gallo
Bill Ramsey called the meeting to order at 7:05 PM.
Minutes:
(1) Don Orser presented the minutes for the February 17, 2004 BRACA Board meeting and they were approved.
Treasurer’s Report:
(1) Elliot Simon presented his report for the period February 18 through March 16, 2004: Road maintenance expenses were $ 18,343.73 ($14K for asphalt and $1545 for prior month snow removal) leaving a combined money market and checking account balance as of this date of $42,252.40. The Administrative Fund income was $155 from voluntary memberships and contributions and a total of $30.14 was spent (Allegheny) for a current balance of $3982.29.
(2) The Perinis situation was briefly discussed and Orser will attempt to find original judgements.
(3) The BRACA Board voted to post the list of Blue Ridge Acres property owners in arrears in their road fees.
(4) Elliot had questions concerning how the corporate tax return was done for year 2003 and the Board voted to let him decide on a person or service.
(5) Total accounts receivable is currently $42,781.16 with $22,040.41 from prior years.
Committee Reports:
Roads Committee: Walter Lipka and Bill Ramsey Reported.
(6) Final payment for paving repair to D. Williams Paving is to be made after “cleanup”.
(7) The issue of culverts was discussed. Hopkins on Persimmon Pear has purchased a 12-inch culvert and is waiting for BRACA to install. Hendricks has expressed interest in paying for a culvert for the BRACA to install.
(8) The mud potentially filling the culvert at the top of Persimmon Pear was discussed and will be watched. Lipka and Orser have taken pictures.
(9) Woodlawn/Redbud/Sycamore potholes were discussed and Walter will try to fill.
(10) The issue of exchanging gravel for road fees was discussed. It was agreed that this could be done but only by exchanging checks and if the gravel was less expensive than otherwise could be purchased.
(11) A small company, Gutter and More, has offered to plow snow for $75 an hour.
Legal Committee: Bill Ramsey reported.
(12) Randy Davis and Don Orser met with Peter Pentony of Nichols and Skinner, on February 20, 2004. Because of conflicts, Nichols and Skinner cannot file collection complaints against about a dozen property owners, including Scanlan. Pentony will proceed with the others, and we will try to find an attorney who can represent us in the remaining cases.
(13) The issue of Julie Meeker’s road fee judgement was discussed. Orser purchased the tax lien in 2001 and noticed the BRACA and a tax lien deed was issued to Orser, which sloughed of the BRACA’s judgement. The alternative was for the BRACA to redeem. Orser has paid road fees on tax lien lots once he has a deed.
Architectural Review Committee: Don Orser Reported
(14) A written report (see attached) dated March 16, 2004 was submitted. (See attached.)
(15) The issue of tree removal and the BRA “tree covenant” was discussed.
(16) Walter will contact Pickering about complying with the BRACA’s request to put them on the ground with extensions closed etc.

(17) A lengthy discussion was had over how to deal with anonymous posters. The BRACA Board voted, as a compromise, to make it a requirement that all posters must register with their correct name etc., to be able to post, but that they could remain anonymous in their postings. A fee of $80 to enable this was donated by Randy Davis. T H A N K S R A N D Y !
Old Business:
(18) Randy Davis and Don have yet to take an inventory of where culverts are needed and report.
(19) The need for writing a generic letter to attorneys who do real estate closings in Charles town addressing the issue of their need to contact the BRACA to insure the payment of road fees owed was touched on. (Orser has agreed to do and has an incomplete draft.)
New Business:
(20) The meeting was opened for questions from guests and a general discussion ensued regarding the need for better communication and education of BRACA’s responsibilities and role for road maintenance.
(21) The meeting adjourned at 8:52 PM.
